We have some important updates regarding changes to Modern Awards that affect workplace delegates, effective 1 July 2024. Here’s what you need to know:
Key Changes
Workplace Delegate Rights
Representation: Delegates can now represent employees in consultations, disputes, disciplinary processes, and enterprise bargaining.
Communication: Delegates can communicate with employees during work hours or breaks.
Access to Facilities: Delegates have the right to use workplace facilities unless impractical due to operational needs.
Paid Training: Employers (excluding small businesses) must allow paid training for delegates under certain conditions.
Some Awards previously had delegates’ terms however many did not.
From 1 July 2024, all enterprise agreements must include workplace delegate rights.
Employer Responsibilities
To comply with these changes, it is recommended that employers:
Educate Managers: Ensure they understand the new delegate rights.
Inform Employees: Make sure delegates and employees are aware of these changes.
Update Systems: Adjust payroll systems to handle paid delegate training leave.
Adverse Action
The Fair Work Act prohibits employers from taking action against an employee because they have a workplace right. This now includes workplace delegates’ rights.
